These Terms & Conditions ("Terms") govern your access to and use of the website mymercypath.com and any related services (together, the "Services") provided by MyMercyPath ("MyMercyPath," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Who you are contracting with

The Services are provided by MyMercyPath. When you purchase Services, your order is processed securely by our payment provider (see Section 7). Nothing in these Terms creates a partnership, agency, joint venture, or attorney-client relationship between you and MyMercyPath.

2. Acceptance and authority

By using the Services you confirm that you are of legal age to form a binding contract and, if you are using the Services on behalf of another person or entity, that you have authority to bind them to these Terms.

3. Description of Services

MyMercyPath provides administrative preparation of federal clemency packages for submission to the U.S. Office of the Pardon Attorney, including intake, document organization, personal statement editing, support-letter formatting, exhibit assembly, and PDF/print production. MyMercyPath does not accept state clemency, state pardon, or state commutation matters.

4. Not a law firm; no legal advice

MyMercyPath is not a law firm and does not provide legal advice, legal representation, or legal eligibility determinations. No attorney-client relationship is created by use of the Site, by payment, or by submission of any form. If you need legal advice, consult a licensed attorney.

5. No guarantee of outcome

Clemency, commutation, and pardon decisions are made solely by the governing authority. MyMercyPath makes no promise, warranty, or guarantee — express or implied — as to whether relief will be granted, the timeline of any decision, or the government's response.

6. Accounts, accuracy, and credentials

You agree to provide truthful, accurate, and complete information and to keep it current. If we provide you with credentials or a private link, you are responsible for keeping them confidential and for activity that occurs under them.

7. Payment terms

Payments are processed securely by our third-party payment provider. Payment card and billing information is collected and processed directly by the payment provider; MyMercyPath does not store full card details.

The total fee for the federal clemency preparation package is $2,500, payable in full upfront. Fees are stated exclusive of any applicable taxes, which may be added at checkout where required by law. Refunds are handled in accordance with our Refund Policy.

8. Client responsibilities

You are responsible for reviewing all materials for accuracy, for signing your own application, and for making your own decision about whether and when to submit the package. You are also responsible for government filing fees, record-request fees, printing, mailing, notary charges, attorney consultations, and any other third-party expenses, which are not included in the fee.

9. Acceptable use and prohibited misuse

You agree not to use the Services to:

• violate any applicable law or regulation;
• submit false, misleading, or fraudulent information;
• send spam or unsolicited communications;
• infringe the intellectual property, privacy, or other rights of any person;
• interfere with or compromise the security of the Site, including introducing malware, probing, scanning, or scraping without permission;
• reverse engineer, resell, or redistribute the Services except as expressly permitted.

10. Intellectual property

The Site, its content, software, branding, and materials are the property of MyMercyPath or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your personal, non-commercial purpose of preparing your own federal clemency package.

11. Your content

You retain ownership of the documents and information you provide. You grant MyMercyPath a limited, non-exclusive license to host, process, and use your content solely to provide the Services and maintain business records.

12. Service level and warranties

We aim to keep the Site available and functional, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the Services are provided "as is" and "as available," and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

13. Suspension and termination

We may suspend or terminate your access to the Services, in whole or in part, with or without notice, for: material breach of these Terms; non-payment of fees; suspected fraud or security risk; conduct that harms other users or the Services; or repeated or serious violations of our policies. On termination, provisions of these Terms that by their nature should survive will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnities, and governing law.

14. Limitation of liability

To the fullest extent permitted by law, MyMercyPath and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to the Services. Our aggregate liability for any claim arising out of or related to the Services will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or personal injury caused by negligence.

15. Indemnification

You agree to indemnify and hold MyMercyPath harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of (a) content or information you provide, (b) your violation of these Terms, or (c) your unlawful use of the Services.

16. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

17. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.

18. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, government action, or failures of third-party providers or infrastructure.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
